In reaching this decision Test Valley Borough Council
(TVBC) has had regard to the National Planning Policy Framework and
takes a positive and proactive approach to development proposals
focused on solutions. TVBC work with applicants and their agents in
a positive and proactive manner offering a pre-application advice
service and updating applicants/agents of issues that may arise in
dealing with the application and where possible suggesting
solutions.

The effect of paragraph 13 of Schedule 7A to the Town
and Country Planning Act 1990 is that planning permission granted
for the development of land in England is deemed to have been
granted subject to the condition "(the biodiversity gain
condition") that development may not begin unless:
(a)
a Biodiversity Gain Plan has
been submitted to the planning authority, and
(b)
the planning authority has
approved the plan.
The planning authority, for the purposes of
determining whether to approve a Biodiversity Gain Plan if one is
required in respect of this permission would be Test Valley Borough
Council. There are statutory exemptions and transitional
arrangements which mean that the biodiversity gain condition does
not always apply. However, based on the information available this
permission is one which will require the approval of a biodiversity
gain plan before development is begun because none of the statutory
exemptions or transitional arrangements are considered to
apply.

3.
|
The applicants attention
is drawn to the contents of the letter received from the Hampshire
County Council Archaeologist in relation to the John O’Gaunt’s Park Pale Scheduled Ancient
Monument. If any works that impact the scheduled monument are to be
carried out, then the applicant would require scheduled monument
consent in consultation with Historic England under the Ancient
Monuments and Archaeological Areas Act (1979).

Bats and their roosts receive strict legal protection
under the Wildlife and Countryside Act 1981 (as amended) and the
Conservation of Habitats and Species Regulations 2017. All work
must stop immediately if bats, or evidence of bat presence (e.g.
droppings, bat carcasses or insect remains), are encountered at any
point during the development. Should this occur, further advice
should be sought from Natural England and/or a professional
ecologist.
