Application for the Variation of a Premises Licence - The SP Bar, 34 Bridge Street, Andover SP10 1BW

To determine an application for a variation of an existing Premises Licence for The SP Bar, Bridge Street, Andover.

Minutes:

The Licensing Manager presented the application submitted by R&SP Limited for the variation of the existing Premises Licence in respect of premises known as The SP Bar, 34 Bridge Street, Andover SP10 1BW.

 

The applicant had applied to increase the existing trading hours, add regulated entertainment and late night refreshment, add the sale of alcohol for consumption off the premises and increase the time that children were allowed on the premises to 2100 hours (currently to 1800 hours). The application had attracted a representation objecting to the application which necessitated it being determined at a hearing.

 

The Sub-Committee were given the opportunity to raise questions of the Licensing Manager.

 

The Principal Environmental Health Officer was invited to address the Sub-Committee.  She advised members that her main concern regarding the variation of the Premises Licence was the potential public nuisance, in particular noise from music and people leaving the premises.

 

The Sub-Committee were given the opportunity to raise questions of the Principal Environmental Health Officer.

 

The Applicants were invited to address the Sub-Committee.  They explained the measures that had been put in place to mitigate the concerns of the Principal Environmental Officer. 

 

The Chairman adjourned the meeting to enable the Sub-Committee to consider the matter.

 

Upon return, the Chairman informed the meeting that the Sub-Committee, in reaching its determination upon the matter, had had regard to the National Licensing Guidance issued under Section 182 of the Licensing Act 2003, Test Valley Borough Council’s own Licensing Policy, together with the representations made at the Hearing and in writing.

 

Resolved:

 

That the Sub-Committee agreed to the following amendments to the Licence:

 

To increase the existing trading hours as applied for save on Friday, Saturday, bank holidays, Christmas Eve and New Year’s Eve when sale of alcohol will cease at 0200 hours, add regulated entertainment and late night refreshment, add the sale of alcohol for consumption off the premises and increase the time that children, accompanied by an adult, are allowed on the premises to 2100 hours.

 

The Sub-Committee also imposed the following additional conditions:

 

·  The Premises Licence Holder will ensure that a minimum of one SIA registered Door Supervisor is on duty from 21:00 until the premises is closed on Fridays, Saturdays and any day the premises are opening past midnight.  This provision will be risk assessed by the Premises Licence Holder and additional SIA registered Door Supervisors must be employed when required.  This risk assessment will take into account any special events and/or any recent incidents of crime and disorder at the premises.

·  There is to be no live or amplified music external of the building.

·  Windows and doors to be closed when entertainment is in progress, other than as low level background music.

·  At each exit point a prominent and clear notice will be displayed to the effect that customers should be considerate to local residents by leaving the premises and the area quietly.

·  The disposal of empty bottles into outdoor storage receptacles shall not take place between the hours of 23:00 and 08:00.
